This Notice of Privacy Practices explains how Cogniivity Science Inc. may use or disclose your Protected Health Information (PHI), and what rights you have regarding your data. Please read this notice thoroughly.
Your Legal Rights
- • Access: You have the right to request access to your PHI. A written request is required, and we will respond within 72 hours. A summary may be provided in place of full records. Copying fees may apply ($35 per page).
- • Amendments: You may request a correction to your PHI if you believe it is inaccurate or incomplete. Requests must be submitted in writing with reasons for the correction. We may deny requests that are already complete, not authored by us, or otherwise not eligible for modification.
- • Disclosures: You may request a list of instances where your PHI has been disclosed in the past six years, excluding disclosures made with your prior consent or for routine operations.
Permitted Use Without Written Consent
Your PHI may be used or disclosed without your written permission in the following situations:
- • For Treatment, Payment, or Operations: This includes coordination of care, scheduling, billing, and internal administrative functions. Information may be shared with staff, business associates, or payment platforms when appropriate.
- • Emergency Care: If urgent treatment is needed and you are unable to provide consent, we may proceed in your best interest and inform you afterward.
- • Legal Obligations: If compelled by federal or state law, law enforcement, or court order, we may disclose your PHI.
- • Mandatory Reporting: We are obligated to report situations involving abuse, neglect, or imminent threats to safety (self or others), in compliance with the applicable laws of our jurisdiction.
Client Consent & Authorization
All other uses of your personal or health-related information will require your explicit, written authorization. You have the right to revoke this authorization at any time by submitting a request in writing to info@cogniivity.com.
Breach Notification
Should a breach of your PHI occur, you will be notified in accordance with applicable laws. We take all reasonable precautions to prevent unauthorized access, use, or disclosure of your data.
Record Retention
All disclosures, amendments, and related PHI activity are retained for a minimum of six years, unless legally required for a longer period.
Privacy Complaints
If you believe your privacy rights have been violated or if you have any concerns about how your information is handled, you may contact us at info@cogniivity.com. There will be no retaliation for filing a complaint.
This notice complies with the Health Insurance Portability and Accountability Act (HIPAA), and California's AB 630, Chapter 229 of the Statutes of 2019, for clients receiving psychotherapy and coaching services.
